LGBT Ex Order and Religious Hiring
President Obama’s July 21 Executive Order banning LGBT job discrimination by federal contractors did not include a religious organization exemption but did leave intact an existing exemption that permits faith-based federal contractors to consider religion in their staffing decisions. Various commentators have sought to interpret that religious hiring exemption very narrowly, such that a faith-based organization would not be able to reject a job candidate because his or her conduct violates the employer’s faith-based standards for employees. IRFA’s president says that such interpretations ignore real-life complexities and essentially simply assert the conclusion that they need to prove.
